Only in this case, a person is allowed to apply independently to the ITU commission. The documents that are drawn up by the attending physician are called messengers. Registration of disability for a child

The assignment takes up to four months. At the same time, an ITU examination is carried out, to which the attending physician is sent.

In the ITU Bureau the following documents must be provided:

Children are not assigned any degree of disability, that is, there are no degrees of severity.

What to do in case of refusal

  3. For children, once during a specified period.

It is categorically impossible to skip the re-examination procedure, since a person may lose the right to be considered disabled. Registration of disability gives the right to receive a special pension, as well as various benefits. Referral to ITU on form 088 / u-06

After the examination, the decision to issue a referral is made by a medical commission, and in some cases - by specially authorized persons from the social security or pension fund. If the competent person believes that there is no reason to issue you a referral, you have the right to independently apply to the ITU (medical and social examination). You should apply there with a certificate of refusal to issue the 088 / y-06 form, which must be required from the attending physician, as well as the documents specified in this list. Plus, the head of the ITU bureau will have to draw up a statement. If it is necessary to establish a disability for a child, the application is filled out by his legal representative (parent or guardian).

In case of refusal to issue a referral and even a certificate confirming the refusal, you can also contact the head physician of the hospital with a written application addressed to him.

A step-by-step algorithm for registering a disability

Step 1. Go to the local clinic for an examination by the doctor who is observing you. He examines and decides if there are sufficient grounds for referral to ITU. The final decision is made by the medical commission (HF), however, the doctors who are members of it express their subjective opinion in this way and do not bear any responsibility for it in fact. Therefore, if you do not receive a referral, you can apply to the head physician or demand a written certificate of refusal to issue a referral from a physician and go with it to the ITU.

To persons without a fixed abode, referrals are issued by the social security authorities.

Step 2. With the folder of the documents listed above, go to the ITU. It is hosted by the ITU Bureau, which has a multi-tiered structure.

The examination is carried out by a board of specialists, whose actions are recorded. Upon completion, a decision is made in the form of an act, which is adopted by a majority of votes. You will be handed a certificate confirming the fact of the establishment of disability, which is an extract from this act.

If the specialists could not make a decision due to the need for additional examinations, then you will be given referrals to the ITU of the next level (main or federal, depending on where you took the examination).

What to do if you disagree with the ITU decision

There are two options:

Appeal against the decision to the ITU main bureau

The solution is the most profitable in terms of saving money and time. You write an application for certification or at the branch, from where it will be transferred to the main office within three days, or directly refer it to a higher authority. No later than one month, the validity of the decision will be verified and you will be invited for a new examination. The examination is free of charge.

Appeal against the decision in court

In this case, you will need to spend money on a lawyer, plus wait until the proceedings begin on your case, because the courts are often overloaded with claims. The judge is not an expert doctor, which means that to make a decision on the claim, he will still have to involve all the same experts from the main bureau.

Which ITU to contact: at the place of registration or at the place of residence

Many people wonder how to get a disability if they are registered in another city. According to clause 20 of the Decree of the Government of the Russian Federation of February 20, 2006 No. 95 "On the procedure and conditions for recognizing a person as a disabled person", a medical and social examination of a citizen is carried out at the bureau at the place of residence residence outside the Russian Federation). It seems to be clearly indicated that the survey may not necessarily be carried out at the place of registration, but there are also some nuances here ...

The fact is that by region there are orders of local leaders of the Chief Experts on ITU, which specific polyclinics issuing forms 0-88 / y are assigned to certain ITU bureaus that serve them.

Patient Gorovenko N.I. issued a referral to the ITU in the polyclinic number 8 in Ivanovo and he was sent to undergo examination ONLY at the ITU bureau # 4 (another bureau will not accept him, as this would be a violation of the local order of the chief expert on the distribution of supervision zones).

Let's assume that N.I. registered in Ivanovo, and lives in Moscow. He has two options for how to get tested:

  • Go to Ivanovo, go to the clinic, get a referral and be examined in Ivanovo.
  • Stay in Moscow, register at a polyclinic (if necessary, apply to the head physician with an application), where they will get an outpatient card for him, get a referral for passing the ITU in Moscow.

But Gorovenko N.I. it will not be possible to get a referral to Ivanovo, but to be examined in Moscow and vice versa.

How to register a disability for a bedridden patient

If the patient does not move and his transportation is not desirable, the patient or his legal representative during the examination by a doctor in a polyclinic may raise the issue of conducting ITU at home. VCh issues the corresponding certificate, which is an addition to the 088 / u-06 form. It is submitted to ITU along with the rest of the documents. Already directly in the ITU bureau, a decision is made where exactly the examination will be carried out:

  • at the patient's home;
  • in the hospital where the treatment is carried out;
  • in absentia, without the presence of the patient.

The procedure for registering a child's disability is not much different from the standard one, except that instead of the child, all documents are submitted and filled by his legal representative. In addition, instead of a production characteristic, it is necessary to provide a characteristic from an educational or preschool institution.

But there are a few things that parents still need to know:

  1. disability group is not established for children, they are assigned the status of “disabled child”;
  2. in practice, there are situations when doctors refuse to give a referral to ITU, arguing that until the child is 3 years old, it is difficult to draw conclusions about the nature of disorders in the body. You have the right to challenge their inaction by applying to the head physician for a referral to the ITU.

Important! When passing the examination, the parents of a young child must be present in the office without fail. When a child aged 14 to 18 undergoes ITU, experts often ask the parents to wait outside the door, but keep in mind that you have every right to be present at this procedure, since you are a legal representative until the child reaches 18 years of age. One and the same disease in one case may become a sufficient reason for a person to be recognized as a disabled person, in another case, the granting of disability may be denied. Stroke

Disability after a stroke can be assigned depending on:

  • The severity of the disease;
  • Stroke type - ischemic (“age-related”, about 80% of cases) or hemorrhagic (rupture of cerebral vessels);
  • The degree of damage to vital organs;
  • Dynamics of recovery;
  • Overall well-being.

As a rule, if, as a result of a stroke, coordination of movements is impaired, speech cannot be restored to a part of the brain, the ITU bureau assigns a disability in the direction of HF.

Heart attack

After a heart attack, not all patients receive disability. ITU mainly assesses the patient's condition with an eye to the possibility of returning to their previous job. They study in detail the production characteristics in order to assess the conditions in which the patient worked. If they were associated with serious physical or psychological stress, then returning to them is unacceptable, and in such cases, ITU assigns a disability group.

Vision problems

A blind or visually impaired person is unable to perform many vital functions. When passing the ITU, vision disabilities can be obtained by:

  • Group 1 - people who are blind in both eyes or with a visual acuity of no more than 0.04;
  • Group 2 - with visual acuity from 0.05 to 0.1;
  • Group 3 - people with moderate visual impairment and acute vision from 0.1 to 0.3.

Postponing an operation

The operation itself is not a basis for recognizing a person as disabled. Rather, on the contrary, in many cases it is performed to improve a person's health conditions. For example, if you have had appendicitis cut out, then no one will recognize you as disabled after the operation. But if, for example, there was an amputation of an arm or a leg, or after the operation there is no positive dynamics of recovery, then the decision on disability is made at the discretion of the ITU bureau. That is, the condition of each patient is assessed during the ITU on an individual basis - there are no general rules on the assignment of disability after surgery.

Term for establishing disability

Disability can be established urgently and indefinitely. The indefinite establishment of disability is provided for those diseases that are listed above.

In other cases, the disability must be "confirmed" after a certain period of time.

In order to prove your disability, you must pass a certification. The procedure is exactly the same as when obtaining a status for the first time, only to the documents it is still necessary to add a certificate of disability and an IPR (individual rehabilitation program), which is issued along with the certificate.

By the way, the disability is considered to be established from the day of submission of the application and documents for passing the ITU to the relevant bureau, and not from the date of the decision. This is important when calculating a pension.

  • the conclusion of the sending institution, the medical commission;
  • passport of a citizen of the Russian Federation;
  • or original;
  • the conclusion of the departmental examination;
  • an act in the form of N-1 (about an accident at the workplace);
  • educational diploma (or other document);
  • power of attorney if the documents are not submitted in person.

Only after the commission has been passed, a certificate of disability VTEK ITU is issued.

It is possible to call the commission at home to a patient who is unable to arrive on his own, upon providing a doctor's conclusion that the person does not move independently.

Is it possible to pass VTEK not by registration?

A sick leave from the ITU Bureau can be issued to a person who is not recognized as a disabled person, and who will still return to duty. In this case, the sick leave is issued with a renewal period of at least 30 days or until the next examination.
