The Supreme Court of the Russian Federation explained what to do if the pharmacy does not have the necessary medicine. How and where to get subsidized medications What to do at the pharmacies of subsidized medications

According to statistics, about 20 million people in Russia have the right to free, so-called preferential, medicines. Approximately 15.5 million of these people choose medication instead monetary compensation, and only about 4 million people enjoy their right to the full.

Who is entitled to such medications in 2019-2020 and in what cases can the state pay for treatment? First things first.

What medications are given free of charge?

Scroll free medicines regulated by the government.

The document confirming their receipt is an order of the Ministry of Health and social development Russia “On approval of the list of medicines dispensed by prescription when providing additional medical care separate groups citizens entitled to receive state social assistance", adopted in 2006, in September.

This document is updated regularly as some drugs are added to the list and others are removed from it.

In 2019-2020, the group of free medicines included all categories of medicines:

  • non-narcotic and opioid analgesics;
  • non-steroidal anti-inflammatory drugs;
  • drugs for the treatment of allergies, gout, and parkinsonism;
  • anxiolytic, anticonvulsant, antipsychotic substances;
  • antidepressants, antibiotics, sleeping pills;
  • antiviral and antifungal drugs;
  • medications for the treatment of the cardiovascular, respiratory, and digestive systems;
  • hormones and many other drugs.
Almost any disease can be cured exclusively with the help of free drugs.

Who is eligible for free medicines

The categories of persons who have the right to free medicines are specified in Article 6.1 of Law No. 178-FZ “On State Social Assistance” dated July 17, 1999, in Article 125 of Law No. 122-FZ of August 22, 2004.

The prescription must indicate its validity period, usually one month. This is the time within which the medicine must be obtained from the pharmacy. If the drug is not available, medication may be offered similar action. The validity of the prescription can be extended, and in this case the pharmacy is obliged to organize the issuance of the requested drug within 10 days.

If it is necessary to continue treatment, as well as in case of loss of the prescription, the doctor is obliged to prescribe the drug again.

Any person to whom the prescription is given can receive free medicine with a prescription prescribed by a doctor. This is especially important when the patient himself is not able to pick up the medicine he needs.

Free medicines for children

Today, children under three years of age have the right to free medicines in Russia, in addition, children under 6 years of age from large families. This also includes children suffering from rare life-threatening diseases whose treatment is extremely expensive.

It is enough to register the child at the place of residence and receive medical insurance and SNILS in the pension fund department in order to receive free drugs if necessary in the future.

If the medicines are not available at the pharmacy

In 2018, the Ministry of Health increased the volume of allocations for public procurement of medicines for HIV-infected people to 21.6 billion rubles. Previously, 17.8 billion rubles were allocated.

According to data conducted by the All-Russian Popular Front social research, most Russians in 2018 are not even able to afford subsidized medications, since in many populated areas There is a shortage of them in public medical institutions and pharmacies.

If you have difficulty receiving discounted medications(queues at clinics, lack of medicines at pharmacies) - don’t give up. Believe that everything will work out for you and be patient! The state provides for the possibility of receiving free medicines for certain categories of the population. But people do not always know how to defend their rights and receive the guarantees they are entitled to under the law.

Disabled people and WWII veterans, disabled people of groups I and II, and disabled children have the right to preferential purchase of medicines. It is for this category of citizens that medications are financed by the federal budget. In addition, children under 3 years of age have the right to receive preferential medications (if the family has many children, then up to 6 years of age). However this information Honey is often kept silent. staff of clinics and hospitals. In each individual region there is a list of citizens who are entitled to preferential treatment. There are also a number of diseases for which a citizen has the right to preferential treatment. At the same time, his status and age do not matter. These diseases include tuberculosis, AIDS, diabetes etc. Sometimes benefits are granted on a permanent basis, sometimes on a temporary basis (for example, after a myocardial infarction, a citizen can count on free treatment for six months). To receive discounted medications, you must visit a doctor and show him:
  • a document according to which you have the right to preferential treatment (pension certificate, veteran’s certificate);
  • a certificate from the Pension Fund confirming that you did not refuse social package, including preferential treatment (for disabled people);
  • SNILS;
  • compulsory medical insurance policy.
Benefits can be obtained if there is a diagnosis established by a highly specialized specialist. The hospital card must also contain a note from the therapist. The doctor will issue you a prescription for a subsidized drug (according to Form No. 148-1у-06(l)) based on the documents provided and the presence of indications for treatment. A certificate with appointments must be signed by a doctor, certified with a seal, a round seal of a medical doctor. organizations. This recipe valid for 2-4 weeks. The local doctor must submit an application to the pharmacist of the city (district) hospital about your need for subsidized medications. You should submit your prescription to a pharmacy that specializes in providing discounted medications. If medications are not available, they will take your prescription and write it down for deferred servicing, and the pharmacist must make an entry in a special journal. The ordered medicine must be delivered no later than 10 days from the moment the citizen is registered at the pharmacy. If this does not happen, you can call the Department of Health hotline and explain the situation. The issue will be under the control of management. A list of preferential medications and other information can be obtained on the Roszdravnadzor website. If you have any difficulties obtaining subsidized medications, you can write a request on the Roszdravnadzor website. The application must indicate your full name, nature of benefits, contact information (telephone, email), residential address. In the text of the appeal, it is important to describe in detail, but to the point, the problems you encountered. The clearer the essence is stated, the greater the chances of a quick and effective solution to your issue. If necessary, you can attach a file to your application. When everything is completed, enter the characters from the picture in the special window and click the “Submit” button.

Who is eligible for subsidized medications?

Certain categories of citizens should be provided with preferential medications. The legislation of our country speaks about this. But not everyone uses their right, since attending physicians simply do not disclose this fact, and pharmacists in pharmacies cannot know at all whether the client has the right to receive medications on preferential terms.

After analyzing the legislation, it can be established that benefits in obtaining medications are provided for:

    recognized disabled people of groups I and II inclusive, as well as disabled children - benefits are provided at the federal level;

    for WWII veterans, regardless of disability - payment of benefits is made from federal budget;

    children under three years of age receive federal and regional benefits;

    children of large families under six years of age – funding of benefits from the federal and regional budgets;

    persons (regardless of age, disability, status) suffering from specific disease those who need to take medications – federal benefits;

    other categories of citizens, the list of which is determined by regional legislation.

Elena I.'s daughter suffers from bronchial asthma. The disease was diagnosed at the age of 4.5 years. The child is prescribed monthly anti-inflammatory bronchodilator medications, which are provided free of charge for the girl. The family does not have the status of having many children; the child is raised in full family with an average level of income.

Why aren't they giving out medications? Unfortunately, there are many reasons for this. The main ones include:

    lack of information about the required benefits from the doctor - the specialist may simply not know that his patient is entitled to free or discounted medications;

    lack of medicine in a social pharmacy - not all pharmaceutical points can dispense medications according to prescriptions, and they are simply not delivered to social pharmacies;

    there is no money in the regional budget, and no transfers are made from the federal budget;

    There is no social pharmacy.

How to find out if medications are eligible for discounts

The legislation in Russia is confusing. There is no special set of laws and regulations on the provision of medicines to people. Therefore, it will be difficult for a private individual to determine whether he is entitled to preferential medications or not. To resolve the situation, it is worth asking a lawyer if the doctor refuses to provide such information. As a rule, advisory legal assistance It turns out to be free, but it is often enough to resolve the issue.

Pensioner Tamara Nikolaevna found herself in a similar situation, whose husband was undergoing rehabilitation after a myocardial infarction. Prescribed medications hit pensioners' budgets hard. The woman asked the lawyers what benefits her husband was entitled to.
After a careful study of the circumstances, experts advised to contact the attending physician and, on the basis of Decree of the Government of the Russian Federation of July 30, 1994 No. 890, request a preferential prescription.

You can also find out whether you can take advantage of the drug benefit by studying the Roszdravnadzor website. However, from the information provided there it is not always clear whether a person has the right to a benefit, or whether he must purchase medicines on a general basis.

What to do if medications are not provided

There are many precedents in the practice of lawyers when people are simply not given subsidized medications, more precisely recipes on them. However, a doctor simply cannot refuse to issue a prescription if his patient is entitled to one. And you should take advantage of this. The algorithm here is simple:

    prepare documents - identity card, health insurance policy, SNILS, medical card or an extract from it (if the right to a benefit is not granted due to illness - a document confirming the right);

    require the doctor to provide a prescription, or a written refusal to provide a prescription;

    support your demand with a reference to a specific clause of the law giving you the right to drug provision on preferential terms;

    with a written refusal (or refusal to write a refusal!) you are sent to the head of the department with a complaint about the doctor’s unlawful actions.

The head of the department (in his absence, the head physician of the medical institution) understands the issue and either requires the doctor to fulfill his duty, or independently writes out a prescription (if he has such a right).

With the received prescription, the citizen must go to a pharmacy that distributes subsidized medications (social pharmacy). Medications must be dispensed upon request and provision of a physician's order. However, drugs may not be available. In this case, the pharmacist makes a note and orders medications. The period for providing a prescription drug at a discount cannot exceed 10 days.

Where to go if medications are not given out within this period? There are several options.

    Contact regional Ministry or the Department of Health via hotline or in person. It is necessary to state the essence of the matter and ask to put the situation under control.

    Complaint about illegal actions to Roszdravnadzor. It can be sent in writing by mail or electronically. The application must briefly and succinctly describe the essence of the appeal, with mandatory adherence to chronology and indication of the facts of violation of your rights at any stage.

    Requirement of a prosecutor's inspection of a pharmacy or inaction of the Department (Ministry) of Health, inaction of Roszdravnadzor. The complaint must be submitted in person, by mail or electronically. The application indicates the essence of the problem, and copies of documents establishing the applicant’s rights to preferential drug coverage and written refusals (if any) are attached to it.

You are not given medicines, where to complain in your case, you don’t know? The article doesn't answer your question? Request a free lawyer from our website by phone or online.

Not many of our fellow citizens know that current Russian legislation provides for a certain number of guarantees for preferential and free drug coverage individual categories citizens. However, practitioners often encounter difficulties in obtaining prescribed treatment, but not everyone continues to defend this right and for this reason they often pay decent amounts of money to acquire what they have every right receive free of charge or on preferential terms. So, there are no subsidized medications, where can I complain?

But before that, you need to understand who is entitled to preferential and free coverage and what is required to receive preferential or free medications.

Who is entitled to preferential and free drug coverage?

  1. First of all, the legislator granted this right to persons with disabilities of 1 or 2 groups, disabled children, as well as veterans of the Great Patriotic War. Patriotic War. For these categories of our compatriots, funds are allocated for the needs of drug provision. cash from the federal budget.
  2. In addition to the above categories of citizens, children under 3 years of age have the right to preferential or free drug coverage. If a child is brought up in large family, then he will have the right to benefits for medicines until he reaches the age of six. This information is usually not provided in district clinics, so most of our citizens are not aware that they have this right.
  3. Also, there is a so-called regional list of beneficiaries, which is approved at the level of each individual subject of the Russian Federation.
  4. Preferential drug coverage may be provided for citizens with diseases specified by law, which include, for example, HIV, tuberculosis, diabetes, etc. In this case, the patient’s age or disability will no longer be taken into account. The law provides for both permanent benefits and those given for a limited period. An example is provision free treatment And medicines persons who have had a myocardial infarction within six months.

What is required to receive preferential drug coverage?

First of all, an applicant for preferential drug coverage in mandatory must visit a doctor with the following set of documents that will be required to prescribe the required drug:

  • Any document that confirms your right to receive preferential medications. This may be a pension certificate, a WWII veteran certificate and other documents provided for by law;
  • Persons with a confirmed disability group must provide a certificate from the Pension Fund of the Russian Federation, which confirms that there was no refusal of the social package provided for by law for persons with disabilities. disabilities, which includes the right to preferential drug coverage;
  • SNILS;
  • Compulsory health insurance policy.

To obtain the right to preferential drug coverage, the presence of a disease defined by law must be confirmed by a doctor of narrow specialization. Also, it is mandatory that a physician record the presence of the disease in the card.

If all these conditions are present, the attending physician writes a prescription in a special form, which is established by law for obtaining preferential category medications. The doctor puts his personal signature and seal on the prescription form. In addition, such a prescription must also be stamped by the clinic. The validity period of this recipe is 2-4 weeks.

After this, an application is made by the local therapist to the pharmacist of the district (city) hospital that a specific person requires a certain medicine under the right of preferential provision of medicines.

After the fully certified prescription is in hand, the beneficiary should contact the nearest pharmacy that participates in the free medicine program. In practice, situations often arise when the required drug is not available this moment no time available. In this case, the pharmacist must enter it into the deferred service and make a corresponding note about it in a specialized journal.

Unfortunately, in practice situations often arise when a doctor refuses to issue a corresponding prescription due to the fact that the corresponding medicinal product Currently not available in the pharmacy. Accordingly, such a refusal is illegal and can therefore be appealed to established by law ok.

The doctor cannot refuse to write a preferential prescription

If the doctor still refuses to write you a preferential prescription, ask him to make an appropriate entry in your card indicating the reason for his decision, that is, the lack of the drug in the pharmacy. According to the law, the doctor does not have the right to make such entries in the chart; he will either still write out a prescription, or will continue to insist on his own. In this case, ask him to make a note that you attended his appointment on that very day.

You can write about such unlawful actions of a doctor a complaint addressed to the head physician of the clinic. Such a complaint is usually drawn up in two copies, one of which is given to the secretary of the chief physician. On the second copy, which remains with you, an appropriate note must be made indicating that your complaint has been accepted. If the secretary refuses to accept your complaint, then it should be sent to the chief physician by registered mail. After receiving a complaint chief physician is obliged to consider it and make a decision on it to bring the doctor to disciplinary liability and to issue a prescription for a subsidized drug.

Where can I complain about the failure to provide a subsidized or free drug?

In a situation where the discounted medicine is not available at the pharmacy upon receipt of the corresponding request, it must be ordered by the pharmacy staff and delivered within 10 days. If the required drug has not been delivered to the pharmacy within the specified period, the beneficiary has every right to contact the Department of Health. There is a special " hotline", where you can freely call and explain the essence of your problem. You can also ask this situation put under control.

Anyone can find the list of preferential drugs on the official website of Roszdravnadzor. This site also provides the opportunity to file a complaint about difficulties that have arisen in connection with receiving preferential or free drug coverage. The complaint is written in free form, but it must include the following information:

  • Applicant's passport details;
  • Address of his actual residence;
  • The nature of the benefits that give the right to preferential drug coverage;
  • Contact phone number or email address.

In addition to the above mandatory details, the essence of the complaint must be clearly stated. All facts should be described briefly but succinctly. The chronological sequence in their presentation is also mandatory. The chaotic form of the story is unacceptable. The outcome of your complaint directly depends on the clarity and brevity of your presentation of facts, so approach this issue with the utmost seriousness.

If any officials or organizations interfere with the exercise of your right to preferential or free drug coverage, you can file a corresponding complaint with the prosecutor's office. The following documents must be attached to such a complaint:

  • Copy of the passport;
  • A copy of a document that can confirm your right to benefit;
  • A doctor's prescription.

Thus, if they do not provide free or discounted medications, then, in my opinion, it is most effective to contact the prosecutor’s office or the authorities executive power in the field of health.
